THE BOONE COUNTY BOARD OF ADJUSTMENT or BOA meets the second Thursday of each month. Meetings commence a 5:30 PM and are held in the first floor conference room of the Boone County Courthouse.
The Board Of Adjustment is comprised of five (5) citizen volunteers. They are appointed by the Boone County Board of Supervisors to a 5-year term and act in a Quasi-Judiciary capacity. In simpler terms the BOA is Quasi-Judicial meaning that it performs it duties and responsibilities as if it were a cross between a court of law and a town hall meeting. The BOA decision is always based on written findings of fact and evidence. The BOA is subject only to appeal in the local court system.
Iowa Code Chapter 335 grants the BOA three (3) special powers:
- The authority to hear and decide appeals in the case of a petitioner who alleges or disagrees with the Zoning Administrator’s decision or determination in the enforcement of the County Zoning Ordinance.
- The authority to hear and decide Special Exceptions or what is commonly referred to as Conditional Uses to the terms in the Zoning Ordinance; and
- The authority to authorize or grant a dimensional variance from the terms of the County Zoning Ordinance where a literal enforcement of the provisions of the Zoning Ordinance will result in an unnecessary hardship; and yet at the same time ensuring that the spirit of the zoning ordinance is observed and that substantial justice in maintained.
BY-LAWS: The Board of Adjustment operates under a set of rules or by-laws. These by-laws set forth in detail the procedures the Board of Adjustment must follow to conduct business in an orderly manner.
